  • Employer dint send H1b papers

    Hi,

    I am Joji , working in Delhi applied for H1 last year and got shortlisted in lottery, applied thru a known friend to NJ based company and employer not yet send the papers , I am asking since Novemebr and they are saying that "we will send once the US market is good else we will see", in this case what I can do ? The company is only just 2 year old.

    Please guide me , it is almost crossed 6 months, atleast stamping must to be done for me, I am just eeagerly waiting for this.

    Please tell me what can be done.

    Nothing can be done as H1b is employer's petition and it is up to them to employ you or not.

      how long h1 visa valid

      Hi,

      I applied for H1 lastyear, got selected in lottery and employer dint send papers till now, since market condition in USA. Now, I would like to know this petition will be valid.

      Or Can I apply again through one more employer for 2010 H1b Visa( by paying $2500 to the employer as a secured deposit)?

      What to be done?

      If my present employer does not send papers in 1 more month, can i take some legal action on them?

        -- you dont have I797, you can't do anything , first I797 is mostly valid upto 3years.
