  • how late can i file I-539 after lay off

    I was laid of in third week of March and I immediately filed I-539 requesting F2 based on my spouses F1 status.
    In some confusion I had withdrawn my application(long story, but I should not have).
    Now effective today, my application is withdrawn.
    So now a month and half after my lay off, can I apply for another I-539 cos.
    I am thinking H4 this time because my wife's H1 was approved last week (of course effective only Oct).

    P.s: Technically my H1 is not revoked yet as per USCIS online status but I do understand irrespective of that its ended the day I was laid off.

    Any help/advise would be really useful.

    If the H1 is effective Oct, then you cannot have a 539 for it now. Also, you are currently out of status and no COS is possible based on how I understand it from your post.

    H1b being revoked or not has got little to do with your status. That is more of a safe guard to the employer than you.
