H1-B renewal and RFE on company
Hi,
My husband's H1 B was submitted for renewal under normal processing (4 yrs in US +2 yrs in India ) Labor filed.The company has asked for 2 yrs extension.
The company he works for is a Indian consulting company and he is an US employee(hired in USA), his company got an RFE from USCIS in Apr-2009 .Hence company would not reveal the RFE details.
Though his company said that it would respond to USCIS in 1 month's time,rumors are that company's usually do not respond to such RFE's and even if they reply,Is it true that such cases have 90% denial rate from USCIS ?
Please if anybody is the same scenario or know anything about it. Please respond.
We are now thinking of applying for a new H1- B through a consultant and then probably transfer to the current company.
Could my husband work on L or B visa through the current company till his new visa becomes active?
What would happen to his pending labor of GC will it be valid?
