    I'm on my L1B visa since Sep 2007. Can I apply for my H1B visa (for the same company or a different company) while in US ? How will my visa status change once I get my H1 visa. Do I have to come to India for my interview or for changing my visa status ?

    ---- Yes, you can. If you apply for a COS from L1 to H1. The change will be effective from Oct 1.

    ---- You need not go to India for a interview unless you have applied for a CP (Consular processing)

      thanks for your reply Subramanya. What is Consular Processing and how can I apply or not apply for it ? does it come into account when I apply for a visa from my parent company

        Form I-129 should mark appropriate field for CP (consular processing) or COS (change of status).

        COS --> You status changes to H1 on the requested start date on I-129.

        CP --> You get a visa and enter on H1 after H1 approval and H1 start date.
