  • Cancelled H1B visa in the passport can be revoked?

    Hi,

    Presently I'm in US on L1 status from Company A, previously when I was in India I had filed a H1 B from Company B and got the visa but never travelled to US on H1B status. When I went to Chennai consulate for L1 visa stamping, they have put a stamp on my granted H1B visa as "Cancelled without prejudice" My question is that my H1 B can be revoked (the validity end is 30th Sept'09)? If yes what is the fees the employer has to pay for revoking the H1 B. Request to clarify on my query.

    Please suggest what is the easiest way filing again for new H1 B or revoking the cancelled one?

    Hi Sridhar,

    I am sorry I got confused by ur query.
    What I can understand is that u r asking " Can u use ur existing H1 Visa which is stamped in ur passport by making it active again"

    If that's the case , then answer is NO , as ur H1 Visa is now Cancelled as per the stamp - Cancelled without prejudice.So it cannot be used again by any chance/any case.

      visa and petition are two different things.
      visa was canceled by the VO at consulate.

      Employer may choose to revoke the petition but there is no cost involved in revoking.
      This is my opinion and not legal advice.
