    I have a big stupid question for respected sr. members.
    I am working for a DESI consultant co.

    While giving offer in India, they took my signature on offer saying I can not leave the company after joining in USA for 12 months and serve 1 month notice too.
    Now I'm in USA and working for him since 9 months.

    >> He did not paid my first salary, upon my arrival for 2 months, stating that we pay once you are on project.

    >> After I got project in here in USA, he again got my signature on agreement paper stating a bond for 12 months and penalty for $10K, if I break any terms.

    I'm not sure he has a power to fill legal case if I break contract and leave his co..

    What options I have to protect, if I join other co. after transferring my visa to other co.

    Please advise, what we can do if I leave company and he fill case against me.
    I don`t want to hire any lawyer services.

    Whatever contract you signed are valid and you may be liable to pay those.

    However, you are entitled for full pay, whether or not on project.

      Hello !!

      But I saw the DOL site, it mentioned their new employee card that nobody is bound to pay anything to employer, not a single penny.

      Check again in DOL.GOV for employee card for H1

        You are confused.

        The contract you signed comes under the contract law, agreement between two parties.

        It different from the labor law. It has nothing to do with Dept of Labor.

          Consult a lawyer. If the employer did not pay you for 2 months, he may have voided the contract and you may not be obliged to follow it.

            Thank you very much for reply.

            But issue is that in agreement nothing mentioned about that he will pay us on bench /off productive. He played very well and spoling many innocent consultant's life in USA by fetching extra money, I heard he has very very strong attorney who is aligator killing us!

            Do you know good employee rights attorny? Do I need to hire attorny belongs to specific state of my employer.

              If you have unpaid wages, your best and free attorney is your state's workforce commission. They practically work for you.

              Regarding contract obligations, you are out of luck.
