  • Working on L1 has Approved H1 (2009- NOT COS) --wanted to shift

    Hi,

Currently i am on L1 , but have approved H1 for the last 7 months (Not COS), now if i wanted to move on H1

#1) Do i need to apply for COS from L1-H1 or directly i can start working on H1 for my employer ?

    Regards,
    Dev Thota

Your employer should apply for change of status to H1.

Not the employer, employee has to apply for COS. Employer may choose to help and pay to do it.
You cannot begin working with H1 employer until approval is received. And once that is received you cannot work for the L1 employer.
This is my opinion and not legal advice.
