    Hello,




    I have few queries about my H1B status and transfer.



    Now, as I understand there is a difference between H1 Status and H1 visa stamp on my passport. Please correct me if I am wrong.


    • <LI class=MsoNormal style="MARGIN: 0in 0in 0pt">My H1B petition is approved, that means I have H1 Status till Oct 2009. right.? <LI class=MsoNormal style="MARGIN: 0in 0in 0pt">As of now, H1 visa is NOT stamped on my passport and I can get it with in a years time. Correct…? <LI class=MsoNormal style="MARGIN: 0in 0in 0pt">What if I want to get it transferred, before I stamped it on my passport, is it possible?
    • My employer have not provided any details to me (like receipt no. or I797) but have conveyed it is been approved. In this case, can I transfer my visa..??



    I would appreciate if you could answer my queries. Feel free to ask for more if required.

      As I have mentioned in my previous email, I have not stamped my visa yet but have the visa status approved and Am in India.

        1. You have status only when you are in the US. You have no US legal status in India.
        2. I don't understand. If you have approved petition, you can get it at any time.
        3. Yes. It would be a new visa and new petition.
        4. There is really nothing to transfer. It will be new visa/new petition anyway.
