  • H-1b, will be on unpaid leave 2 months before H-1B expires...no paystub

    Hi everyone,

    I will be working until 7/31/2009 and then will be on unpaid leave for 2 months until my visa expires on 9/30/2009, i will still be an employee during this time, but not being paid. During this time IF i find a job and they need 2 or 3 recent paystubs, I won't have paystubs for 2 months, what will happen to my H-1B transfer?

    Also, how can I extend my stay longer than 9/30/2009? Some mentioned B visas but when should I apply?

      Your employer MUST pay you as long as you are an employee. That is the law. No exceptions.

        but they said i will be on unpaid leave.... i get benefits and a ticket home at the end of 2months.... How do I make them pay for the two month?

        now, can someone answer about extending stay by file for Change of status? How and when should i apply for b2?
