  • Can I hold H1 and L2 simultaneously?

    Hi all

    I have a valid H1-B visa stamped till May 2010 and am not in USA. My spouse is working on L1-B visa in the US. I have tranvelled to the US with the H1 visa last year.

    Can I now apply for a L2 visa? If I get an L2 visa, is my H1-B still valid or it becomes inactive once I get my L2 stamped??

    Pls help!

    The visa officer reserves the right to mark any visa as CWOP. As one is a dependent visa and the other is a work visa, they might end up cancelling the visa. That does NOT mean the H1b petition or your ability to get back on H1b is cancelled. You can get back to H1b when you need to provided the petition is valid and after applying for a visa stamp.

    You can mention to the VO that you plan on using H1b later on and they might choose to leave it without the stamp.

      L2 -h1

      My L2 visa stamping happened in March in India, then my old H1 stamping was stamped "Cancelled without Prejudice" my H1 petition is valid till Nov 2010.. Does it make my old petition in-valid?
