Hello,
I have a situation like below:
1) H1B transfer for me + h4 for dependents: Petition mailed on April 14th, 2009 but got a receipt with date 29th April, 2009
2) New H1B for my spouse: Petition mailed on April 1st, 2009 but got a receipt with date 22nd April, 2009
Question: What happens to my spouse's status if my H1b is approved before her's and what happens to her H1B if her H1B is approved before mine. My dependents' I-94 expires on 09/30/2009. Do they have to leave the country if there is no update on our H1-Bs.
Inspite of the validity until Feb 2012 on my previous I-797 the officer at PoE gave I-94 for my dependents only until Sep 30,2009. Not sure why.
