  • Travelling to India - Old H1 to New H1

    Hi All,

    I'll be travelling to India and need to know if I need stamping or not:

    I have valid visa till Sept 2010 from my old employer

    I have an approval notice till Sept 2011 from my new employer.


    This year I changed employers in Jan and now I want to travel to India in december - Do I need stamping to come back or what?

    Appreciate your help.

      Thanks txh1B. It was indeed mentioned in the FAQs. Is this available on USCIS website somewhere also?

        Google for Foreign Affairs manual. I posted it on the forum too. You need to use the search function and look.

          -- When visa is valid you can travel USA - India and return back on the same Valid VISA India - USA. You can change Numbers of Employer but the visa already stamped is valid for you to travel with new I797 of current employer, you dont need to go back for new visa stamping for any new employer. when visa will expiered and you want to travel outside USA that time you need valid visa stamped or go for stamping in Mexico, Canada or India.

            Hi Guys,

            Few more questions -

            My wife is on F1 COS (we did the the H4 to F1 COS) - so now she has:

            Old H4 visa till Sept 2010 (based on my old H1).

            New COS approval notice for F1

            Does my wife need stamping or can she enter on old valid H4 - because you're saying that I can also enter on my H1 from my old employer.

            Please clarify. Thanks.

              She can enter on H4 but will be maintaining H4 status. Any benefit associated with the F1 COS will be lost and so would be OPT/CPT etc. Talk to the ISO before you decide to enter on H4.

              If she wants to maintain F1, a new visa stamp is needed.

                I also tried googling for the foreign affairs manual - Can you briefly point me where I can find that no stamping is required when H1 visa has been transferred but old one is still valid.

                    can't find mr txh1b. Only thread that links foreign affairs manual to an h1b stamping is this one. Just guide me a little bit whenever you have some few extra moments. thanks a lot.

                      How could I find it????

                      I felt like saying either trust what I say or talk to a lawyer. Would be rude but off late people just want everything to be served on a silver platter and don't want to look at all.

                        Agree. Sometimes I ignore similar repeated questions for that reason. People just want a custom tailored response for their situation and are just not ready for that one extra step to draw similarities from other's posts and find answers on their own.
