  • entry into POE without I797.

Hi.. I have a valid H1b with my current employer. But seems like they arent interested in sending me to US again. Iv talked to the HR and they said if i quit the company they would get back my petition(I797) but would spare the visa stamping in my passport. I wana know if it is possible for me to travel to US on my own expense and get entry at POE without a petition letter. I do not intend to stay there but have got few monetary issues to be settled with people i've known there.

Entering on a H1b petition without intending to work for an employer is fraud. You should never do that.

You can have the H1b transfered over to a new employer. Just keep a copy of the petition.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

No, you can't, will be asked for the original petition at PoE. For the purpose you are travelling you need to apply for B2.

You can enter with a copy provided you are going to work for the employer. Entering without intending to work for an employer is fraud and you will be arrested and removed.
