  • Applying for H1B

    Hi.

I'm wondering if anyone can tell me what the process is to obtain an H1B visa. I currently have a TN which will expire the beginning of September and I was told by USCIS to switch to the H1B before my current visa expires. So, I have two weeks to make this happen and am wondering if this is doable and what I need to do.

    Thanks!

Your employer is the one that need to do this as there is not much an employee can do as far as H1b sponsorship goes.

Employer pays and files for the H1b paperwork. New H1b starts Oct 1st. So, even if you do have H1b filed, you still have to leave by Sep 1st as your new status (unless approved) will not begin until Oct 1st.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
