  • I-94 Expired

    Hi,

My i-94 expired on April 4th and my h1b extension filed on Feb 5th got rejected on August 10th. Until when can i stay in the country with out getting any Bar ? is it until 179 days after April 4th or 30 days from denial date ?

    Please help,
    Thanks

The illegal stay count starts from day of I-94 expiry not from the date of denial.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

thanks txh1b, but i heard there is a 180 day grace period before i have to leave the country. otherwise there will be a bar for 3 years or so. so i wanted to know if i have to leave by Sept end (180 days from April 4th) or 30 days from the denial date.

      Thanks.

There is no grace period. 180 days of illegal stay after expiry of I-94 earns you a 3 years ban to enter the US. You should try to minimize your illegal stay as it impacts your future immigrant or non-immigrant visa applications and blemishes your immigration history.
