  • Employer not giving the denial letter

    Hi,
My employer is not ready to give me my official denial letter on my H1 B visa. I want to transfer my H1 B visa to another employer. I have the receipt number of my previous H1 B application but not a copy or the actual denial letter.

Can I only send the receipt number and the print out the case information online and send it to my new employer for my H1 B visa transfer or do I require the actual receipt?

If you already have a H1b approval to prove your cap count, you do not need a denial letter to transfer the H1b.

If you never had a H1b approved, the denial will not have you an assigned quota number and is of no use to you.

I see no use for the denial letter and employer is NOT required to provide you anything as it is employer's petition.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
