    Hi,

    My Visa expired on 28 APril 2009 and I have applied for extension in March 2009.
    I got a RFE in June and my employer has submitted evidence for the RFE.
    Now my Wife is in her 7th month pregnancy and we are expecting baby in December 1st Week. My 240 days period will come to an end in December, that time we cannot travel with new born.

    Can I apply for a temporary (3 months) stay so that I can fly safely with my family.

    There is no extension of stay possible as the I-94 already expired. Read about "bridging" on the forum.

    You could possibly stay past 240 days but should not work. Discuss your options with the attorney that filed your H1b extension.
