H1B Visa Stamping in Chennai

Hi,
My current employer I797 expires on september 30th 2009, but my previous employer visa expires on oct 7th 2009(The previous employer would have canceled the H1b status, not sure). As my 6 yrs of employement ended i returned to india with my wife on Sep 21st 2009.

my wife had applied for H1B employment on july 1st 2009 and it got approved on 23rd sept 2009.

Can we both or my wife alone, enter Usa with previous visa which expires on oct 7th 2009?

Was your wife on H1b before? If not she has to go for stamping. She can no longer enter U.S in her H4 visa. She has to get her H1b stamped. In order for you to travel with her, you need to get a H4.
