Hi all,
Here is the scenario:
1) my wife entered US on H4
2) she got H1, starting from Oct 1, 08
3) did not get project till May 09
4) submitted for COS to H4 with leave letter in May 09
5) Sep 23-online status - Denied
as of Oct 3, not yet received notice by mail
Interesting thing:
now she has project in hand.
employer has not cancelled H1 yet
Questions:
1) will she has to leave US?
2) If yes, can she go to Canada or Mexico?
3) H1 not cancelled and H4 denied. Does it mean her H1 is valid? Can she join new project on H1?
Pls advise asap.
