    Hi All,

    I came to US on a F1 visa ,and got my status changed to H4 in JULY 2009,
    My H4 status shows that it expires in coming JANUARY 2010.
    My Husband has his H1B status till OCTOBER 2010.

    Now if I go to India in the month of DECEMBER,
    How and where should I get my Status renewd ?

    Should I get it done in US or India?

    Kindly answer ...

    If you return back from India before your existing H4 visa expires, then you might get an I-94 that is valid till the date on the approval notice (I-797) of your husband. Remember to carry it with you. In case you get an I-94 that expires before that (close to your visa stamp), then you will have to apply for the H4 extension. Check form I-539 in immihelp.

    If you plan to return after your current H4 visa expiry, then you need to go for H4 stamping in India. Check the H4 document list in immihelp that you will require for you stamping.

      As you don't have a H4 visa stamped, when you get a visa for H4, it will expire based on your husband's I797. The new I-94 that you get at POE will be until the DOE of his I797.
