URGENT: Legal Status After H1b Expired

My I94 Expires on Sep 2010 and my current employer has send in the termination paper work to INS this week telling them that my last date is 16th OCT 2009.

Can I still accept a job offer and apply for a H1b transfer after 16th OCT ?

---- If your I-94 has already expired in Sept. you are accumulating illegal stay within the US. Immediately apply for B1 status before even looking for a job and transferring your H1 to another employer

---- In all fairness you should consult an attorney to address your situation completely. Be quick and jump in to do all these things

While the F1 is pending (not approved) can I still accept a job offer and use H1b portability ?

Presently I am very confused and frustrated with the whole process bcas of the time crunch situations.

I have job offers but the whole LCA process is not working for me, denied twice.
