  • Urgent - Changing from L1A to H1B

    Dear All,

    I need your valuable suggestions on changing from L1A to H1B

    I am working for company A and came here on Jul 2004. And still my I94 is valid until Jul 2011.


    I have 2 options

    a) Stay here on L1A until Jul 2011 on company A ..go out of this country for 1 yr and come back on fresh H1B

    Or

    b) Apply for H1B now and continue to work on L1A...in the mean time I search for project while H1B is under process. Once H1B approved I can shift to company B.

    My question is that ..

    1) I have already completed 5 yrs on L1A, so Am I be eligible for H1B? If am eligible.. will I get H1B for 3 years ?

    2)The combination of L1+H1B stay in USA must NOT cross 5 OR 6 yrs? Is it true?


    Please explain me pros and cons of this situation.

    L1+H1b is 6 years. I don't think H1b is a possibility for you as no other extension is possible unless a labor was applied 1 year before the 6 year term completes.
