My wife has been working on H1-B since October 2007. Her H1 was valid till September 30, 2009 and her employer (Indian consulting firm) filed for an extension just prior to Sep 30th. In the first week of October, her application received an RFE asking for the end client documents. Unfortunately, her project also ended around September 30th and so there was no way for us to submit the documents. So, she left the country and will comeback next month on a h4 visa. Her employer also revoked her h1 extension last week citing (in the form of a letter to USCIS) that the project was scraped.
So, here are my questions:
1. Is it possible for her h1 revocation to be denied by any chance?
2. If H1 revocation is denied, can it impact her chances when she goes for h4 stamping in India or at the port of entry when entering US with her new h4 visa stamp?
3. What happens if she comes back on h4 and then her h1 revocation gets denied? Will it have any impact?
4. Will there be any impact of her h1 revocation on future h1 petitions?
I would appreciate any answers for the above questions.
