  • L1 to H1 transfer

    Hello Seniors,

    I am on L1 currently for company A. ANother company B have applied for H1b in mid October and it got approved this week. The employment start date in
    I129 is 9th Nov. Now the joining date to company B is 16th Nov.

    So I will have to resign from Company A on 13th. And after two days I will join company B on 16th.

    Is there any legal issue in this. Whether this out of status will have any impact?

    Please suggest.

    If the I797 came with an attached I-94, check what the validity date on it is. That is the effective date of your COS. Any employment with L1 after that is illegal.
