  • Seeking H1B Visa Stamping Advise

    I'm currently in USA and working. I entered USA in Dec 2006 on H4 dependent visa. I have H4 dependent stamping on my Passport from New Delhi via. my spouse employer. In Jan 2007, I applied for H1B visa through my sponsoring employer A with I-797A H1B from Oct 2007 through Oct 2010. Unfortunately, employer A went bankrupt and I immediately got my H1B transferred to employer B and currently on H1B which is valid from Oct 2007 through Oct 2010. I have been working in USA since Oct 2007 until now. I plan to visit India and get my H1B Visa stamping in my passport for the first time this month. At present I have my I-797A H1B PETITION valid in papers until Oct 2010 but do not have H1B stamping on my passport. My passport place of issue is chennai.

    Question 1: Can I get my H1B Visa stamped in Hyderabad Consulate as Hyderabad is my place of residence currently in India and given my current situation?

    Question 2: On the vfs-usa.co.in website, when booking for a consulate date, should I say "Yes" or "No" to the below question given my situation as explained above. Please advise.

    Purpose of Travel:* -- Select -- Working in the USA Spouse/Child of person working in the USA
    Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*

    Q3: Do you foresee any issues in specific for such cases with getting H1B visa stamped in passport if all the documents are in place? I know this is a broad ended question. I leave it to your judgement to provide inputs based on your past experiences and expertise.
