Hello friends,
My wife was on H4. Her I-94 based on my earlier H1B, is valid till Feb 1010. I recently got my H1B extended till Feb 2013.
She got her H1B this year (started Oct 1st 2009). She didn't get paid in Oct. I will be complaining to DOL. She needs to change to H4 now. I have been told there are 2 ways to do this.
1. APPLY FOR COS WITH FORM I-539
1a) Could this be risky without her October paystub?
1b) Would attaching a copy of the complaint form with DOL help?
2. TRAVEL OUTSIDE AND RE-ENTER US ON H4.
2a) Can anyone please explain this process?
2b) Will she get her H4 extended till Feb 2010 (based on her old H4 visa) or Feb 2013 (based on my new H1B)?
2c) Does she have to cancel her H1B by filling any form before the travel, or is done automatically when she re-enters US on H4?
