I am working in a startup, with H1B effective from october-2009. I was with the same employer on L2-EAD till then, and applied for COS and got it approved. I am 9 months pregnant now, and I got my maternity leave approved for 3 months after delivery(by email). And I promised to return for work after that. Because of the financial status of the company, my employer says, I may be laid off, as they cannot pay me for my absence from work.
I believed, employers get the compensation from State government to pay for the short term disability of the person. And the company policy states " a pregnant woman receives the same benefits as a person with short term disability".
Now what should be my call? Can I get laid off just because I am pregnant?
