  • H4 and B1/B2

    Hi,

I have applied for H1B cap.
My wife is already having a B1/B2 visa which is valid for 10 years. If I process H4 VISA for her, then what will happen to her B1/B2 VISA? Will they cancel her B1/B2 visa?

    Thanks and regards,
    John

If your Wife is already in the US, on B1/B2 visa, she can stay for a max of six months. She had to leave the country and come back at least after a month. However, if you apply for an H4, it is going to be a change of status and can stay in the country till the date mentioned on her I94 (Usually the same as Spouse's H1B I94 date) which comes along with the approval notice.

If your wife is still in your home country, then she has a to go for an H4 Visa stamping and her B1/B2 Visa will be void. Visa is a travel document and any individual can only have one valid visa type at any given time.

    Hope this helps!
