  • H4 Stamping

    Hi,

My wife used to be on H1B. After losing her job, she changed her status to H4 thru my H1. Right now, she has a H1 stamp in her passport. We want to travel to India in Dec. So,

    1. Would there be any problem at the consulate regarding the H4 stamp?
    2. Would the H1 stamp cause any additional problem?
    3. What happens if at all they reject to give the H4 visa? Could we apply again?
    4. Would there be any problem to get H1 stamp after H4, if she gets a job after returning to US?

    Please let me know,

    thanks

    1. Would there be any problem at the consulate regarding the H4 stamp?
    >>>> No.

    2. Would the H1 stamp cause any additional problem?
    >>>> No.

    3. What happens if at all they reject to give the H4 visa? Could we apply again?
    >>>> Yes, you can re-apply. Chances of H4 rejection is less. As long as the primary H1B holder (You) is maintaining the status, H4 stamping will go smoothly (Assuming there are no criminal offense/fraud committed).

    4. Would there be any problem to get H1 stamp after H4, if she gets a job after returning to US?
    >>>> Not if she has all the required documents for the H1B.
