H4 Re Enter in USA while H1B is Out of Status

Hello,
I am in USA and my H1B is Out of Status. "Just Fighting with Company"


Now My Q is:

My Spouse want to go to India & want to come back with in month. Our Visa is Valid for another year.

Is there any problem He can face while coming Back. or What are the Documents the Immigration People Ask for.

Need Advice ASAP so he can plan accordingly.

They may ask for the employment verification letter and latest pay stubs at the POE to prove that the primary H1B holder is in valid status.
