  • H4 Extension

    Hello, My H1B is expiring Jan 2010 and wife's H4 also expires at the same time. I have applied to extend my H1B and have only received a notice of receipt. We have not submitted the I-539 for extending her H4 status thinking that she can travel and get a new visa stamped in her passport. And now we are thinking that we should have submitted as we are looking at delaying our travel plans.

    - Can we still submit this given that I have already submitted my H1B Extension.
    - How long will her extension last once approved?
    - If not approved by expiration on Jan 2010, will her status in the US still be legal?

    1. Yes. Include the copy of the H1b reciept along with all other materials.
    2. Depends on the duration of your H1b extension.
    3. If the extension was applied and reaches USCIS prior to the I-94 expiration date.
