  • H1B and H4 go outside the States

    Dear All,

    Our family (1 x H1B and 2 x H4) plan to go back to homeland for the holiday eg. 1 month while we just arrived US approx. 5 months and our visa is still valid. Our employer has accepted but wonder is there any problem with the USCIS when we return back to the States after the holiday ? M/w, what are the essential documents that we should bring along to show to the USCIS @ the airport when we return back ?

    1) Employment verification letter from your employer.
    2) Client letter (If you work at the client location) mentioning that you will continue to work for them after you return back from vacation.
    3) 2 -3 latest pay stubs to prove that you maintained the H1B status while in U.S.
    4) Valid H1B petition, Visa and passport
    5) Valid H4 visas and passports
    6) Copy of the marriage certificate

    That should do.

      Thanks Shervin143 for your advice. M/w, just kindly be checked that is there any foreseen problem if we travel such a long time eg. 1 - 1,5 month while just arriving the States for work about 5 months (Our employer approved for the holidays and our visa + H1B petition are still valid)

        That should not be a problem. But since you will be traveling back after 1.5 months, the immigration officer might look for the proof that you still have the job available. Like mentioned earlier, carry the employment verification letter/the client letter and you should be good.
