  • H1 to H4 COS

    Hello All,

I'm holding a valid H-1 B visa till September 2011. My project was finished on Nov 30th 2009. I'm planning to change my status to H4. I have pay stubs till the end of November. My H-1 B is not yet revoked. My employer said that he would revoke my H-1 at the end of December. So what is the right time to file my COS to H4? If I'm late, will there be any issues for my COS? Is it necessary to go through an attorney and have COS done?

would really appreciate a quick response.

    Thanks in advance

As you have pay stubs until Nov, better to apply for COS ASAP. If it's delayed you may have to provide Dec pay stub also.
    Attorney is not necessary.

To avoid problems, travel and return by getting a H4 visa immediately as you are technically out of status the last day of your job. .

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
