Need Help

Hello Everybody,,,,
I am here on H1 Since 05. Due to the market situation, my boss( he is good he didnt fire me) is paying me only 30 hours a week since last September (2008).

Am I in trouble because my h1 is based on 40 hour a week...... if so any solution ...

now my boss wants to do my GC processing, is it possible to start the processing with my present situation. Do you thing its a good idea to apply for GC in present market......please help..
Seniors please advise....

You will have issues in future (Visa stamping, extension, GC etc) if you get paid less than what is mentioned in your LCA. If your employer can pay only 30 hours/week, then an H1B amendment need to be filed to USCIS and it should get approved.

GC can be filed any time. If all the documents filed are genuine, then there is nothing to worry.

thanks for quick reply....the amount on my W2 for 08 was greater than the amount in LCA as we were doing good in the firs t half of the year.

now this year my w2 will have less than what is stated in LCA. can I just get a bulk check from my employer to make it equal to waht is stated in LCA so i wont have a problem in future when they check the W2. .....
i know its not completely legal but i think this is the only way i can keep my w2 amount correct so dont have problem in future.....please advise...
