H1B help appreciated

Hello,

I am in a situation like I am on OPT right now that expires on april 13 2010. I got an approval for my H1B but I don't want to work with that employer. I applied with another employer but they forgot to sign in one page and the application has come back and per my friend and USCIS website H1B quota is closed on 12/21/09. So once i get approval for my H1B does my OPT expires?

Yes. The "Valid From" date on your H1B approval is when your status changes to H1B (In other words, the OPT end date).

Since you have got one approval already, another employer can file the petition for you without going through the cap.
But if your previous approval was a change of status case, your status will change to H1 from the valid from date and you can no longer use OPT. In this case you will be out of status if you don't work for this employer and any new petition may be approved for consular processing only.
