  • L1 to H1 conversion.

    Hi,

    I am currently on L1A status and working for company A.

    I applied for H1B w/o COS and received the approval notice couple of days ago. I do not have any job offer on H1 yet, and I am still working for company A on L1.

    1) is it OK to still continue working for company A on L1?

    2) I would like know how should I proceed to apply the COS from L1 to H1.

    3) What is the cost of fees for applying the COS from L1 to H1. If I apply for premium processing ?

    4) How long it would take to get the COS from L1 to H1.

    5) Will it OK if I start working for a company B if I get the COS receipt number ?

    Yes

    Employer has to file amended petition or you may leave, get H1 visa and enter.
    3) What is the cost of fees for applying the COS from L1 to H1. If I apply for premium processing ?
    Petition filing fees + 1000. Employer should pay.
    4) How long it would take to get the COS from L1 to H1.
    15 days for premium, 2-3 months otherwise.
    5) Will it OK if I start working for a company B if I get the COS receipt number ?
    No you have to wait for approval. Travel and enter with H1 visa if you don't want to wait.

      L1 to H1 conversion

      Hi,

      I am in L1 visa from company A for the last 3 years and if I want to apply for H1 B from company B still do i need to go via CAP?

      If not then then company B is ready to file premium H1.

      Kindly help me out.

        Yes, you have to go via CAP.
        Try in April 2010.

          No cap since you already have an approval. Premium is different.
