  • do I need to have project for H1 extension?

    Hi,
My H1b expires in Sep 2010.my project gets over in Dec 2009. I have no idea when i ll be getting the next project.
Is it necessary that i should be working in a project at the time of applying extension? This is my first extension..

    Please do clarify..
    thanks.

Yes. If you work for a consulting firm, then there will most likely be an RFE for the client letter (If you apply for extension without it). You can apply for extension 6 months in advance. You don't have to wait till the last minute.

Regardless of being on a project or not, the employer MUST pay you.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
