L1 - h1 cos

Hi,

I am currently working on L1. Have H1-B approval from 2009-CAP.(NOT COS). Now i got a good offer from other employer. To join that employer we can apply for COS form L1-H1.my question is..

# in case if the COS (L1-H1) get rejected / denied. does it mean that i should not use this H1 any more or can i go to india for stamping with the same H1 approval papers ?

The current petition will still remain valid. You can go for visa stamping with the approval notice and other related documents from your first H1B employer for whom you already have the approval.
