H4-H1-H4 no paystubs please help

I came to US on H4 and in later applied for H1 in 2008 and got approval from Oct 08. But because of bad economy I could not find a project and my employer did not pay me. Now I want to go back on H4. What are my best options?
-Should I apply for COS while staying in US with receipt of DOL complaint or go back to my home country and apply for H4 to re-enter.
-What are my chances of getting the visa?
-OR should I go ahead and apply for COS without DOL receipt?
I heard from many people that USCIS don't have that much time to see all the details of each individual case as there are thousands of applications.
Please someone give me the right advice.

- Chances are less for COS approval. Better leave and reenter on H4.
