  • H1 to L2 Visa

    Hello,

    I am currently a H1-B Visa holder. My employer does not have projects in the location where I am, and hence I have not been working for the past few months. I am with my husband who is on a L1 visa. I want to now apply for a new L2 visa.

    My questions are:
    1) I do not have recent paystubs to prove my active H1 status. Is this going to cause a problem during L2 visa interview, can they possibly ask me to prove my H1 status?

    2) My visa status is currently inactive, so should I go right away to India and get my L2 visa, or can I delay it by a few months and go in May and get it done then?

    1) Most probably, no. So should not be a problem.
    2) if you're in US, your stay is illegal as you're not being paid. Better leave and enter on L2.
