  • Indian Passport Renewal question

    Hello Guys,

    I am an Indian Citizen working in the US under H1-B Visa. Currently my H1-B visa is valid until Oct 15, 2010. My Passport is valid until July 06, 2010.

    Can I go to India and come back from Jan 30 - Feb 21?

    I heard from multiple sources that you cannot visit India if you Passport expires within 6 months (which it will on Feb 06).

    But since I have a valid Visa and I dont need to apply for a Visa Extension, I think it does not make any sense.

    Hi Ashay ,

    Nobody can stop you from entering INDIA just because your passport is about to Expire and that too you are going to your home country.

    yes , you can travel to India and come back to US on Feb 21 on the visa which is expiring on Oct 15, 2010.

    Only thing you have to make sure that while coming back at POE - I-94 is sometimes given till the end date of Passport (instead of the Visa end date or I-797 end Date) , so you may get I-94 till the end date of Passport (July06'2010).
    So you have to apply for an I-94 extension and also need to renew your passport before that

      Thats a bit of a relief . I am definitely planning to renew my Passport once I get back. Could you also point me to I-94 extension docs if they give me an I-94 doc which expires on July 6, 2010 ?

        Your company need to file for H1B extension. If the extension is approved, you will get a new I-94 attached to it. You should ask you employer to file for the extension before the current I-94 expires (If they go by normal process, then it is advisable to apply at least 3 months in advance.)
