  • EB3-India I-140 approved but going back to India to change job

    Hello,
i have a rather unique situation. I am on h1-b visa. My I-140 was approved in 2016. My priority date is dec 2014. My next visa extension is due in Apr 2021. If I go back to India now and join another employer, would my GC process still continue until it becomes current ? In that case can the new employer take over the H1B after my application becomes current and file for AOS ?

I think that only if you have an approved I-140 and filed an I-485 that has been waiting for more than 180 days you can port your job to another company and still retain the same PD.
I think that also if you have an approved I-140 and your new employer will do a GC sponsor for you. they will have to file a new PERM and I-140 but your PD will still be the same as before.

Not 100% sure if this applies to your case
