  • H1 Transfer and Extension

    My I 94 expires in 5 Months.My Employer is going to apply for extension in 2 months.

    I need to know, If I transfer my H1 now, will I get a new I 94 with extension or I need to file for transfer and extension from my new employer.

    Also Can I file for new h1 this april, so that if my h1 extension is denied I can exit US in and re enter to start working for new h1 from oct 2010.

    Lastly, I havent applied for GC, If my present employer files for GC now, does it mean I dont need to apply for extension or its done automatically.

      Just to confirm, So if I file for h1 Transfer, I will get my another 3 years of h1 and updated 3 years I 94.Is that Correct?

        The transfer will be approved with an extended I-94 as per the project itenary provided by your employer. If project itenary is only for 1 year, then you will get an extended I-94 only for 1 year. However, you can keep applying for extension until you each the 6 year limit on H1B.

          Thanks for your answers.

          Please let me know, If my employer apply for an extension and it gets denied.Can I find a new project for a new employer and apply for h1 transfer then?Or after extension denial I have no option?

            Possible if you have a valid I-94 and recent pay slips. If the I-94 is expired, then transfer is not possible.
