    Hello everyone,

    I am in United States from last 5 years on H1B and I have few doubts mentioned below when I am filling DS 160 for my to be spouse living in india to file for H4 Visa Application.

    1. We will be getting married in end of May 2010 and planning her H4 visa interview at mumbai u.s. consulate approximately on first week of June 2010. In this case what should be her home address? Will it be mine address where my parents live OR her's parents address where she have lived before marriage? Reason I am asking is because in the help provided states that the home address is the address where the applicant have resided for the last 6 months.

    2. Under travel information the form asked for Prinical Applicant's Applicant Receipt/Petition Number. Is this EAC number on my H1B Approval Notice I797?

    3. Should I fill I134 Affidavit to support for her H4 application? If yes, Do I need letter from bank stating my Account Information?

    4. My to be spouse and I will be coming back together once her H4 visa is granted. In this situation can I still write myself as U.S. point of contact information.

    5. Lastly, the H1B Approval Notice (I797) I have contains a tear off right bottom part stating my I94. Should I tear this part from I797 and staple with the I94 given by the officer at port of entry? If yes, wont I loose this when I make a trip to India to get married along with the I94 given by officer at POE.

    5. You've to surrender all I-94's before leaving. you will get new one while entering US again.

      1. In general, I suggest providing the address that is on her passport. But the address that she has been residing for the last 6 months should also be fine.
      2. Guess it's the EAC number
      3. I don't think you need I-134 for your spouse. However it is best to carry all financial documents. No harm in filling the I-134 too.
      4. Yes, I have done that without any problem.
      5. Remove the I-94 from the 797 and staple it to your passport (preferably adjacent to the visa page). At the POE, the officer will take the I-94 and issue you a new one.

          DS 160 for h4 appointment before marrige

          I have the same situation. I want to take an appointment for my to be partner before marrige. I have some question for filling the form DS 160. I will be really helpful if anybody can give me reply of following doubts I have.

          1) Can I fill up the form and take an appointment before marrige.
          2) The form required us to select the marital status for my to be partner. Since I want to take an appoitment before marrige. His status is single so what should I mention. Married or single. I was concern because H4 visa is based on the marrige.

          Please let me know if anybody has any suggestion. Thanks

            >>> The answer depends on what kind of visa you are applying for. If it is a dependent visa, then the answer is NO. You can fill the application before marriage. But the interview has to be after the marriage for a dependent visa.

            >>> The application that you are filling should have information as of the visa interview date. So you can answer "YES" if you will be married on the date of the visa interview.

              1) The address you provide in the visa form can be her address or your address. Because when I stamped my H4 visa I gave my husbands address which was mumbai to get interviewed at Mumbai consulate and it was just 1 month after marriage. Because the address what you provide decides the consulate as it is region specific.
              In my case I was from Karnataka and passport had Karnataka address. If I had provided Karnataka address as the place resided last 6 months it would have given me Chennai consulate. Instead I decided to give my husbands passport address which was Mumbai and as a result got interviewed at Mumbai consulate which was convenient for me as I was in my husbands home in Mumbai.

              I hope you got my point. If both of you are from same state it doesn't matter.
              But if yours is a case like mine you can write the address according to your convenience

                Thanks priya! We both are from two different states and both states candidate have to go mumbai u.s. consulate for visa interview. I have put her address after people replies to my question because if at all they ask her to give a proof of living for last 6 months then she will be in a situation to produce the same.

                  In your case it does not matter much as any address would lead to Mumbai consulate. In my case it was different. My home address would have led me to Chennai consulate and Husbnds address to Mumbai consulate. And it would have been foolish of me to go to Chennai consulate being in husbands home in Mumbai when there was a consulate at Mumbai. As far as stamping was concerned they know the fact that by virtue of marriage wife will be in husbands home. So the guy at the consulate did not ask me questions like when your passport address is Karnataka why did you write Mumbai address etc.

                  But above suggestion is only for people who go for H4 or any other dependant visa stamping only.
