Urgent - H4 Stamping

Hi,

Please help me with situation..

I have an approved H1B petition (I797) with company A till Jan 2011. I was a full time employee and was laid off 4 months back. I filed my H1 transfer onto company B which is still in process. My wife has an approved H4(I797) with company A and valid till Jan 2011 but the stamping was expired. She went to India two months back. My question is: Do I need to wait till my new H1 is approved for my wife's stamping Or she can go to stamping with Old H1 and H4 approval papers? Please answer my question...

She should wait for your new approval to come. Old H1B petition might be revoked and one should not go for stamping with a petition (I-797 of primary applicant) if the primary applicant no longer works for that employer. Look at the H4 visa documents check list in the "Visas" section of immihelp.
