    I got laid off on H1B. My company has not informed INS about my lay-off.
    So officialli i am still legal because my I-94 will expire in Feb. 2011. I have a question about income tax return. Is there any risk in filing Income tax return, considering the fact that i am laid off and the amount on my W2 is very less comparative to my previous income tax return. Do INS has any connection with income tax department.
    Please advice.

    You seem to be worried about IRS.
    But what you should worry about is INS.

    Your stay is illegal after you laid off, no matter what I-94 says.

      Irrespective whether the company has revoked your H1B or not (They might have already submitted the aplication to revoke your petition), when layed off, you are considered illegal (Unless you have transferred your petition to another company). You need to get paid and maintain pay slips for future extensions, visa processings and GC. If not, this will cause issues later.
