  • H1B Visa - In-house Project

    Hi,

    I am currently working in India for "X" Company.
    I hold a H1B Visa from "Y" Employer, which is valid until Sept 2010. I haven't used my Visa since last 2-1/2 years.

    Now my Employer "Y" has an in-house project.

    1) Can I enter US on my H1B Visa to work on the in-house project for my employer?
    2) Is it legal to work on the in-house project being on H1B Visa?
    3) What documents are required at the Port of entry to prove that I will be working on In-house project?
    4) When should I apply of extension of my H1B Visa. I just have 6 months validity.
    5) Will there be any issues in the extension process?

    4) 3-4 months before expiry of current H1

      Just some points to keep in mind.

      Do not quit company 'X'. Take an extended leave of absence.
      Do not sign any kind of bond or contract with company 'Y'.
      If you go to the US and join company 'Y' and then you realize company 'Y' does not pay you or is a fraud (most IT consultancies that claim to have in-house projects are fraud), have enough money to stick around until you return home and join company 'X' again.
