If you are questioned by police is it necessary to declare it (even though it's not an arrest) ?

    DS-160? - Arrested or Convicted?

I'm helping someone to fill up their DS-160 and one of the questions was a questions ask for the appropriated way to answers.

Questions: "Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?"

YES or NO and if YES answers Explain:

The issues was that person was arrested, almost a month on Jail, because neglected to pay personal LOAN because was Lay off from work.

HELP! what will be the appropriate answers! HELP!!!

Ofcourse, the answer need to be "Yes". Mention the same reason for arrest after selecting YES. They would have this records against his SSN and the consulate can easily figure it out. He should fill the DS160 with all the facts and explain the reason for arrest to the VO.
Not a legal advice. Use of this information is strictly at your own risk.
