    I am on H1B with employer A and myscheduled repatriation date is 23rd March 2010.

    My wife also having valid H1B visa with employer B and currently working in US.

    I am trying my best to transfer my visa before 23rd March, if not possible then I want to change my status to H4 with my wife employer B.

    My question is:

    1) how many days before I have to start H4 process?
    2) how much time it will take to get H4?
    3) Is there any premium process concept for H4 also?

    because my employer (A) will cancel my H1B status from March 24th onwards.


    Appreciate your help.

    >>> Anytime before current h1b status ends (Before your last working day with your employer if you haven't applied for transfer).

    2) how much time it will take to get H4?
    >>> 2-3 months

    3) Is there any premium process concept for H4 also?
    >>> no. why would you need premium for H4? whatz the rush?

      Hi

      I am working with employer A and asking me to repatriate by March 23rd.

      I do have petition from employer B and employer B applied while I was in India.

      My wife also have valid H1B visa from employer C and currently she is working.

      Since I would like to continue to stay here, Please let me know the best possible solution to continue my stay in US.

      Scenario 1:
      -----------

      1) go back to India as suggested employer A.
      2) go to stamping with employer B petition
      3) come back US with employer B visa

      risks: 1) no gurantee i get stamped in present situation.
      2) no guarantee at POE
      3) finding job in US by staying in India is too difficult


      Scenario 2:
      -----------

      1) change my status from H1 to H4 (my wife employer C) in US
      2) then find job in US and then again COS from H4 to H1 (employer B).

      risks: 1) no gurantee COS
      advantages: I can stay in US atleast on H4 and face client interviews in US and getting job opportunity is more.


      Anyone please suggest me which scenario is best to pick.

      I feel that my two legs are in two different boats, Please suggest me best approach to handle.

      Please add more if you have any +ve and -ve points with any scenario.

        thanks for the response.

        I am in rush since I want to get H4 status ASAP and then again transfer to H1 since I have valid petition. In the mean time I will try to find job.

        Just to keep my legal status in US.
