    Hi,

    I work for employer A on H1-B and have approved I-140 with the same employer. My H1b extension was denied and I moved to H4. Now employer A has filed for a fresh H1b (consular processing) that was approved last month.
    I also got a job with another employer and since I don't have a valid H1b what would you recommend?
    1) Should I go to India and get H1b stamped and then transfer
    2) File for H1b with employer B and go to India to get H1b stamped.

    I am having the same situation My current visa is in extension and got offer from second employer who filed for my transfer and was provided RFE which asked for current petition status. When i asked second employer for next steps they said they will do consular processing and i need to go out of us and get it stamped.

    I asked them to wait for my current petition decision and will then decide what to do. Also if my current extn is denied i dont have any other options then to go back to india and get this new visa stamped and come back.
